Shipping plays a vital role in helping to build the Australian economy. This sentiment was reflected on 13 August 2010 during the federal election campaign when the Minister for Infrastructure and Transport, the Hon. Anthony Albanese MP announced that a “re-elected Gillard Government will introduce measures to strengthen Australia’s shipping industry for our economy and our environment.”
As a transport industry, the shipping sector faces real risks every day, including the risk of ship collision, grounding and infrastructure allusions. These all pose major public safety and environmental concerns to the industry, and they also present wider business and reputational ramifications, particularly in terms of environmental consequences.
At R2A, we work with companies in the shipping sector to help them minimise the chances of such risk eventuating. We do this through the development of due diligence safety case arguments to ensure all sensible practicable precautions are in place, based on the balance of significance of the risk versus the effort required to reduce that risk.

In July 2010, R2A completed a due diligence safety review for the provision of pilotage services at Port Hedland - Australia’s largest port in terms of tonnage. The outcomes were included in the Pilotage Operations Safety Management System (POSMS) for the port.
A generalised common law safety case approach was used to document that all statutory, regulatory and common-law requirements were met. It consisted of a number of arguments demonstrating that all reasonable practicable precautions are in place for all credible critical issues including grounding, collision and allision. Issues were identified on a zonal basis.
During the review on-site, a number of tasks were completed, including a due diligence briefing to stakeholders and legal counsel, documentation review, observation of pilotage services, generative interviews and a final sign-off briefing and presentation.
R2A have completed a number of marine pilotage due diligence reviews in Australia and New Zealand.
R2A have developed a robust model for Marine Pilotage Due Diligence which provides an arguable case for pilots and pilotage organisations in the event of an incident.
